Registration at the place of stay is a mandatory procedure for foreigners and stateless persons temporarily staying in the Republic of Azerbaijan for more than 15 days. It is regulated by the Migration Code of the Republic of Azerbaijan (Articles 21.2-21.5), the Law of the Republic of Azerbaijan “On Registration at the Place of Residence and Place of Stay”, and the Regulations on its implementation. Upon crossing the state border, such persons are issued a corresponding notification regarding the registration requirement in Azerbaijani, Russian, and English languages.
Citizens of the Republic of Azerbaijan, as well as foreign citizens and stateless persons (hereinafter referred to as “persons”), are subject to registration at the place of residence and place of stay. Registration is carried out for the purposes of maintaining records of persons residing in the territory of the Republic of Azerbaijan, ensuring the fulfillment of their obligations towards other persons, the state, and society, as well as the realization of human and civil rights and freedoms, including social protection, pension provision, military registration, enforcement of judicial acts, and other measures provided by law.
Registration at the place of residence and place of stay is not a permissive procedure and may entail legal consequences only in cases expressly provided for by the legislation of the Republic of Azerbaijan.
When conducting registration at the place of residence and place of stay, it is prohibited to require documents not provided for by this Law.
The place of residence is the place of permanent or predominant residence of a fully capable person on lawful grounds (as owner, under a lease agreement, rental (sub-rental), or on other grounds), including residential houses, apartments, official residential premises, dormitories, homes for the elderly and disabled, and other residential premises (Article 2 of the Law of the Republic of Azerbaijan “On Registration at the Place of Residence and Place of Stay”).
The place of stay is the place of temporary residence of a person (Article 2 of the Law of the Republic of Azerbaijan “On Registration at the Place of Residence and Place of Stay”), including hotels, sanatoriums, rest homes, medical institutions, and other similar organizations, as well as residential premises that are not the person’s place of permanent residence.
Registration at the Place of Stay for Stateless Persons
A stateless person arriving in the Republic of Azerbaijan for a period exceeding 30 days is subject to registration and deregistration at the place of stay in the manner established for foreign citizens.
Filing Complaints Related to Registration
Refusal of registration in oral or written form, requirement of documents not provided for by this Law, as well as unjustified delays in the procedure may be appealed to the authorized state body or in court.
No state fee is charged for registration of foreigners and stateless persons at the place of stay.
Initial registration of a foreigner is carried out within 15 days from the date of entry into the country. Registration is conducted in electronic format through the electronic services section on the official website of the State Migration Service, via email at qeydiyyat@migration.gov.az, the electronic government portal, or in person at regional offices of the State Migration Service and ASAN Service centers, accompanied by a copy of the passport or other border-crossing document.
The following documents are required for registration:
- Application form/questionnaire;
- Copy of the passport or other travel document of the foreigner, including pages with visas and the stamp of the last entry into the country.
Failure to complete registration at the place of stay within the period established by law serves as grounds for administrative liability.
A foreigner or stateless person has the right to apply independently for registration at the place of stay in the manner established by legislation.
Upon receipt of the application, the authorized executive authority immediately enters the information into the Unified Migration Information System and performs the registration at the place of stay, notifying the applicant within one working day.
Registration of foreigners and stateless persons is carried out for the following periods:
- For persons who entered on the basis of a visa – for the period of stay specified in the visa;
- For persons who entered under a visa-free regime – for up to 90 days.
Registration of foreigners and stateless persons under the protection of the UNHCR Representation in the Republic of Azerbaijan is carried out by the authorized executive authority for the duration of such protection based on information provided by the Representation.
In the event of departure of a foreigner or stateless person from the place of stay, the receiving party or the person themselves must notify the authorized executive authority thereof. Based on the received information, deregistration is performed. Upon expiration of the established registration period, foreigners and stateless persons are automatically deregistered.
When the place of stay of a foreigner or stateless person changes, registration at the new address must be completed within 5 working days from the date of arrival, in the manner provided by legislation. If a foreigner or stateless person temporarily resides in another apartment (residential premises) belonging to the same owner at whose address they are already registered, re-registration is not required.
