Types of Intellectual Property

Copyright and Related Rights
Copyright protects literary, scientific, artistic, musical and other works. The author enjoys personal non-property rights and economic rights to use their work.

Related rights protect the interests of intermediaries in the dissemination of works:

  • performers (for live performances and recordings);
  • producers of phonograms (for sound recordings);
  • broadcasting organizations (for radio and television broadcasts).

Related rights derive from copyright and are regulated by the same law.

In Azerbaijan, copyright arises automatically upon creation of the work – registration or deposit is not required for protection to exist. Since 1996, Azerbaijan has maintained a registration system for copyrighted works.

A geographical indication is a sign showing that a product originates from a specific region and possesses special qualities, reputation or characteristics attributable to that geographical origin.

Trade secrets: formulas, processes (e.g., product recipes) – protected without registration, provided confidentiality is maintained.

Topographies of Integrated Circuits (ICs): three-dimensional layout of active/passive elements and interconnections in semiconductor substrates that ensure the electronic function of the microchip.

Databases: a systematic or methodically arranged collection of independent materials (works, data or other objects) accessible electronically or otherwise.

Utility Model Patent (“small invention”): protects new and industrially applicable technical solutions of a smaller scale (new device design, mechanism, etc.). Requirements: novelty and industrial applicability (inventive step not required). Simple and fast registration process. Term: 10 years (non-renewable).

Industrial Design Patent: protects the appearance of a product – shape, ornament, color scheme, configuration. Requirements: novelty and originality. Term: 5 years, renewable up to 25 years (in 5-year increments). Examples: designs of mobile phones, furniture, cars, packaging.

In Azerbaijan, trademarks, patents, industrial designs, IC topographies, databases and deposited copyright objects are registered through the Intellectual Property Agency.
